Cannabis Legalization and Regulation in Nebraska
Nebraska has not legalized recreational cannabis. Possession, sale, and cultivation remain illegal statewide. Possession of small amounts (less than 1 ounce) is treated as a civil infraction for first offenses, but repeat offenses or larger amounts can result in criminal charges.
Medical cannabis was approved by voters in November 2024. Patients with a physician’s recommendation may possess up to five ounces of cannabis once the program is implemented. The Nebraska Medical Cannabis Commission is responsible for licensing cultivators, processors, dispensaries, and testing facilities. Emergency regulations are in place, and the program is expected to launch by October 1, 2025. Until then, no legal access exists for patients.
The Omaha Tribe has separately legalized both medical and adult-use cannabis on tribal lands. Adults 21 and older may possess up to one ounce and purchase through tribally licensed retailers. This makes the Omaha Tribe the first jurisdiction in Nebraska with a fully legal cannabis market.
Hemp with no more than 0.3% THC is legal under state and federal law. Hemp-derived CBD products are widely available, but intoxicating hemp cannabinoids such as delta-8 THC have been targeted by state enforcement actions and face bans or restrictions.
For cannabis operators, Nebraska represents an emerging but tightly controlled market. Banking and financial services providers will require strict compliance once the program launches, including license verification, tax IDs, ownership details, operating agreements, and financial statements. Given the cash-heavy nature of cannabis businesses, operators should prepare for secure armored transport, reconciled deposits, AML/BSA monitoring, and audit-ready accounting practices to maintain access to banking services.
