Cannabis Legalization and Regulation in Iowa

Iowa has not legalized adult-use cannabis. Recreational possession, sale, and cultivation remain illegal statewide and are subject to criminal penalties.

The state operates a limited medical program known as the Iowa Medical Cannabidiol Program, established in 2014 and expanded in 2017 and 2020. Registered patients with qualifying conditions—such as cancer, epilepsy, multiple sclerosis, Crohn’s disease, chronic pain, and PTSD—may obtain a physician’s certification and purchase medical cannabidiol products. Patients may legally possess up to 4.5 grams of THC every 90 days, unless a physician certifies a greater need or the patient is terminally ill.

Smoking and vaporization of raw flower are prohibited. Approved forms include capsules, tinctures, topicals, creams, patches, edibles, and vaporized oils. Home cultivation of cannabis plants is not allowed.

The Iowa Department of Health and Human Services oversees the program, including patient registration, physician certification, and licensing for cultivators, manufacturers, and dispensaries. A small number of licensed dispensaries operate in the state under strict regulations, with vertically integrated operations required to ensure control from cultivation through retail.

Hemp and hemp-derived CBD products are legal in Iowa if they contain no more than 0.3% THC and are produced under the state’s hemp program. However, intoxicating hemp cannabinoids such as delta-8 THC are prohibited for sale and enforcement actions have been taken against unlicensed distributors.
