Cannabis Legalization and Regulation in Louisiana

Louisiana has not legalized adult-use cannabis. Recreational possession, sale, and cultivation remain illegal under state law. Possession of small amounts (14 grams or less) has been decriminalized, carrying a $100 fine without jail time, but larger amounts still carry criminal penalties.

Medical cannabis was legalized in 2015 and became operational in 2019. The program allows qualified patients with a physician’s recommendation to access cannabis in multiple forms, including flower, oils, tinctures, capsules, edibles, metered-dose inhalers, and topicals. Smoking raw cannabis flower is prohibited, but patients may vaporize flower or use other approved forms. Home cultivation is not permitted.

The program is regulated by the Louisiana Department of Health, in coordination with the Louisiana Board of Pharmacy and the Louisiana Department of Agriculture and Forestry. The state initially authorized only two licensed cultivators (Louisiana State University and Southern University partnerships) and a limited number of licensed pharmacies to dispense medical cannabis. This highly controlled structure ensures tight oversight of production and retail sales.

Hemp and hemp-derived CBD products are legal in Louisiana if they contain no more than 0.3% THC. Products must be registered with the Louisiana Department of Health and comply with packaging, labeling, and testing standards. Intoxicating hemp-derived cannabinoids such as delta-8 THC are restricted and may only be sold under cannabis program regulations.
